These terms govern your use of doitwithbrio.com and any purchases made through it. The website is operated by Tim Schmid, 6382 Buren NW, Switzerland.
By accessing this site or placing an order, you agree to these terms. If you don't agree, please don't use the site.
Products and ordering
We sell custom 3D-printed pens and ink refills. When you order a pen, you choose the colors for the cap, body, base, and ink. Each pen is 3D printed and assembled based on your selection.
- Product colors on screen may vary slightly from the physical product due to display differences
- As a 3D-printed product, your pen may show visible layer lines and a print seam. These are characteristics of the manufacturing process, not defects
- Orders are placed through Shopify's secure checkout
- We reserve the right to refuse or cancel orders in exceptional circumstances (e.g., suspected fraud, stock issues)
How ordering works
Here is how the ordering process works:
- You configure your pen or select your products on our website
- You add items to your cart and review your selection
- You proceed to checkout on Shopify, where you enter your shipping and payment details
- Before placing your order, you can review and correct all details. You can also go back to change your cart at any point
- By clicking the order button at checkout, you place a binding order (offer). This creates an obligation to pay
- We confirm your order by email without delay. This confirmation is our acceptance, and the contract is formed at that point
Product listings on our website are an invitation to make an offer, not a binding offer on our part. We reserve the right to decline orders in rare cases (for example, if stock is unavailable or we suspect fraud).
Pricing and payment
- All prices are shown in CHF (Swiss Francs) and are final prices. We are not subject to Swiss VAT (MwSt) under Art. 10 MWSTG
- Shipping costs depend on your destination and are calculated at checkout. They are shown before you place your order
- Payment is processed securely by Shopify Payments. We never see or store your payment details
- Prices may change at any time, but changes won't affect orders already placed
Shipping and delivery
Our pens are made to order. We typically produce and ship within 1-2 business days after your order. Estimated total delivery times from order to arrival:
- Switzerland: 3-5 business days
- EU countries: 5-12 business days
These are estimates. Actual delivery times may vary depending on carrier performance, customs processing, or high order volume. We are not responsible for delays caused by shipping carriers, customs, or events beyond our control.
Returns and right of withdrawal
We offer a 14-day return window on all products, no questions asked. For full details, see our return policy.
If you are based in the EU: our pens are custom-made to your color specification. Under the EU Consumer Rights Directive (Art. 16(c)), custom-made goods are generally exempt from the right of withdrawal. We choose to offer returns anyway, but please be aware that this is a voluntary policy on our part.
Ink refills are standard (non-custom) products. EU consumers have a 14-day right of withdrawal for ink refills, provided they are unopened.
Warranty
All our products come with the statutory warranty (Gewährleistung) under Swiss law. For consumer purchases, the warranty period is 2 years from delivery (OR Art. 197-210). This period cannot be shortened and your statutory rights are not affected by any other provision in these terms.
If you are based in the EU, the legal guarantee of conformity under your national law applies (at least 2 years). During the first 12 months (24 months in some countries), any defect is presumed to have existed at delivery unless we can show otherwise.
A warranty claim covers manufacturing defects and non-conformity with the product description. It does not cover damage from misuse, normal wear, or exposure to conditions outside the product's intended use (for example, temperatures above 55°C).
We also offer a 30-day hassle-free defect response: if your pen arrives damaged or has a defect, contact us within 30 days and we will resolve it quickly with minimal back-and-forth, including covering return shipping. This is in addition to your statutory warranty rights, not a replacement for them.
To make a warranty claim at any point within the 2-year period, email us at hello@doitwithbrio.com with your order number and a description of the issue.
Intellectual property
All content on this website, including text, images, designs, 3D models, animations, and brand assets, is owned by doitwithbrio / Tim Schmid.
You may not reproduce, distribute, modify, or create derivative works from any content without our written permission.
Automated access and AI training use
You may not use bots, scrapers, crawlers, or other automated systems to collect, copy, or republish substantial portions of this site without our written permission.
You may not use our content, images, or data to train, fine-tune, or evaluate machine learning or AI systems unless we have explicitly agreed in writing.
Reviews
- By submitting a review, you grant us a non-exclusive, royalty-free license to display it on our website
- Reviews must be honest and reflect your genuine experience
- We reserve the right to moderate or remove reviews that contain offensive, misleading, or inappropriate content
Limitation of liability
We do not guarantee uninterrupted or error-free operation of the website. As far as the law allows:
- We are not liable for indirect, incidental, or consequential damages arising from the use of this website
- For product-related claims not covered by statutory warranty or product liability, our total liability is limited to the purchase price of the product in question
Nothing in these terms excludes or limits our liability for intent, gross negligence, personal injury, or claims under the Swiss Product Liability Act (PrHG). Your statutory warranty rights (see Warranty section above) are not affected.
Governing law and jurisdiction
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer in Switzerland, you may bring claims at the courts of your domicile or at the courts of Canton Nidwalden, under Art. 32 ZPO.
If you are a consumer in the EU, this choice of law does not affect the mandatory consumer protection rules of your country of residence. Under the Lugano Convention, you may bring proceedings at the courts of your domicile or at the courts of Canton Nidwalden, Switzerland. Any proceedings brought by us against you as a consumer will be brought in the courts of your domicile.
For non-consumer disputes, the place of jurisdiction is Stans, Canton Nidwalden.
Dispute resolution
Tim Schmid / doitwithbrio does not participate in dispute resolution proceedings before a consumer arbitration board.
If you have a dispute arising from an online purchase in Switzerland, you may contact the E-Commerce Ombudsman (Ombudsstelle E-Commerce) operated by the Swiss Consumer Forum: konsum.ch/ombudsstelle-e-commerce
Privacy
Your use of this site is also governed by our privacy policy, which explains how we handle your data.
Changes
We may update these terms from time to time. If you keep using the site after changes, you're accepting the new terms. It's worth checking back here now and then.
